Bond advises ČS on the fund financing of the ARX CE V Fund
Together with the finance team of Wolf Theiss in Prague, Bond Advocaten recently advised Česká spořitelna, a.s. on a secured bilateral subscription (capital call) facility financing.
The financing will be provided to ARX CE V Coöperatief U.A. and will be used for bridging capital call financing, bridging management remuneration payments to the fund manager and repayment of a maturing tranche.
This transaction involved multiple Dutch law considerations, particularly in relation to Dutch corporate and investment funds law, as both the borrower and its manager are Dutch legal entities.
