Our fellow partner Robert Steeg finished the second part of an article about credit support provisions in loan-linked ISDA Master Agreements which was recently published by Sdu in Tijdschrift Financiering, Zekerheden en Insolventierechtpraktijk. The full text of the article (which is in Dutch) is available on our website. The aim of Robert's article is to help hedging counterparties under a loan-linked ISDA Master Agreement to determine on what conditions they could generally accept that transaction security documents and guarantors would not be defined as credit support documents and credit support providers (respectively) in the schedule to such ISDA Master Agreement.
